Parents of girl killed in street sue 20 people
THE parents of an 8-year-old girl killed in a road accident have sued 20 people involved in the accident and demanded compensation of more than 1.33 million yuan (US$193,440), it was revealed yesterday at the Pudong New Area People’s Court.
Among the accused are the people directly involved — a nanny surnamed Wang, a bike rider surnamed Lu and a bus driver surnamed Gu — as well as the owners of cars parked on the roadside where the accident occurred, and insurance companies.
The accident happened last May 16, when the girl was riding with Wang on her motorbike, en route from school to home. Wang used the motor vehicle lane as the non-motor lane was occupied by cars parked by parents picking up children, the court said.
Wang tried to overtake Lu from the left, but to dodge a pedestrian, Lu swerved and collided with the motorbike. The girl fell into the middle of the road, at which point Gu was pulling out to overtake. A rear wheel of the bus ran over the girl, and she died at the spot, the court said.
Wang and Gu were each granted a one-year reprieve last October from a 12-month sentence on charge of causing traffic accident. At yesterday’s trial, the girl’s parents said Gu should take the main responsibility for causing the girl’s death because he was exceeding the speed limit and in the wrong lane. They claimed if Gu had not violated traffic rules, their daughter could have survived despite the actions of the other defendants.
Wang agreed, but added Lu’s responsibility was the same as hers because it was Lu who had caused the girl to fall off. Lu responded Wang had “hindered” his riding.
The owners of the cars parked on the roadside also denied being guilty of any wrongdoing.
No decision was announced by the court yesterday.
