Man wrongly convicted of murder seeks 15m yuan in compensation

A man who was freed after six years on death row is seeking 15 million yuan (US$2.41 million) in compensation after he was wrongly convicted of murdering two children in Fujian Province in 2006, state media said today.

Shopkeeper Nian Bin, 38, has repeatedly said police officers You Jingfei and Weng Qifeng tortured him and threatened to arrest his wife to extract a confession.

He is suing Fujian Intermediate People’s Court for 15 million yuan after it upheld his death sentence three times. He said the court deprived him of his freedom and withheld medical treatment while he was in custody.

Nian also wants the court to apologize in major media outlets.

The case dates back to July 2006, when Nian rented an apartment in Aoqian Village from Chen Yanjiao. He opened a shop and competed for customers with his neighbor Ding Yunxia.

On July 27, 2006, six people from Chen and Ding’s families suffered food poisoning. Two of Ding’s children died and traces of rat poison were found in their bodies. Nian was detained several days later after police said traces of the poison had been found on a door handle at his home.

Police said Nian confessed on August 8, telling them he wanted to teach Ding a lesson because he had “stolen” one of his customers.

In court, however, Nian said the confession had been extracted under torture.

His conviction was overruled in August and Nian was released from prison.
