Tutor banned as well being sent to prison

A teacher who molested a female student has been banned from the classroom for three years in addition to a two-and-half-year jail term.

He is the first teacher in Shanghai to receive court-imposed restrictions on employment over sex offenses, according to prosecutors of Minhang District.

Restrictions on employment were added to the amended Criminal Law in 2005, which said courts could impose a three to five-year ban on employment to prevent criminals taking advantage of their positions to commit crimes.

The teacher surnamed Qian, who is in his 40s, was barred for three years from working in education — whether teaching, tutoring or caring for children — prosecutors said.

They added Qian had given cramming classes at his home, and the victim, a junior middle school student, had attended his classes.

One day last July, Qian asked the girl to stay behind after other students had left, saying she needed further coaching to catch up. He took the girl to his bedroom, and hugged and kissed her, the court said.

The girl reported what had happened to her mother and police were called. Qian tried to deny his guilt, saying the girl had seduced him, the court said.

Last November, Qian was sentenced to two and half years behind bars on charge of molesting.
