Famous Shanghai dumpling brand wins lawsuit against Ningbo copycat

A 20-year-old Shanghai dumpling brand won nearly 1.14 million yuan (US$168,151) of compensation from a copycat in Ningbo City, Zhejiang Province, in a trademark-infringement lawsuit, according to a verdict made yesterday.

Tangyuan, a traditional Chinese dumpling dessert usually stuffed with sesame or red bean paste, is a traditional and one of the signature foods of Ningbo city. Shanghai Longfeng is a famous brand of Tangyuan and well-known among Shanghai consumers.

The copycat, Ningbo Longfeng tangyuan brand, emerged in 2012, which later alerted Shanghai Longfeng. The Shanghai company filed a lawsuit, accusing it of unfair competition, and asking for compensation of 3 million yuan.

The Pudong District People’s Court made verdict yesterday, charging Ningbo Longfeng with trademark infringement.

The court said Ningbo Longfeng “deliberately abused the fame” of Shanghai Longfeng by highlighting the brand name and also used the a similar design in its package as that of the Shanghai company, causing confusion among consumers.  

It was ordered to stop infringement immediately and offer nearly 1.14 million yuan as compensation.
