Boy wins payout after penis hurt by toilet seat
THE incident happened on July 31 last year, when the child, nicknamed Liang Liang, was using a toilet at a 4-star hotel in which he was staying with his parents.
The hotel’s management apologized to the family after the incident, but the parents were not satisfied.
After returning to Shanghai — their hometown was not named — for follow-up medical treatment three months later, they appealed to the hotel’s owners for compensation.
When they refused, the parents filed a lawsuit with the Changning court in March of this year, demanding 84,000 yuan compensation to cover their medical and travel costs.
In court, the parents claimed the hotel should be held responsible for the safety of their customers and that the injury to their son’s penis had been caused by a faulty toilet seat.
The hotel countered that the parents should not have allowed a 3-year-old to use the toilet unattended, and said that all of its facilities met relevant quality and safety standards.
In an investigation carried out on August 8, court officials found that the offending toilet seat had been replaced in May.
Because of the loss of evidence, the court ruled that the hotel should be partially liable for the incident and ordered it to pay the family 17,000 yuan in compensation.
