App to pay for damaged cornea

A cosmetologist and a phone app developer have been ordered to share a 20,000 yuan (US$3,126) compensation payment yesterday after an eyelash extension service sold via the phone app damaged a customer’s cornea.

The app developer said in its defense at the Xuhui District Peoples’ Court that it was simply acting as an intermediary between the cosmetologist and potential customers and should therefor not be held responsible for a product’s or service’s quality. The court, however, found that the app developer had to ensure that only professional products and services were being sold. The court also pointed out that the developer made a profit from the service and ordered it to pay 30 percent of the total compensation, or about 6,667 yuan.

The plaintiff, surnamed Liu, used a phone app to order a 250-yuan eyelash extension service to her home last year. A cosmetologist arrived the next day to glue fake lashes to her natural eyelashes. When Liu complained about a burning sensation, she was told that the adhesive simply had to dry out. Yet three days after the treatment, Liu‘s condition only continued to get worse, leading her to seek medical attention. She was diagnosed with an eye infection and hyperaemia caused by exposure to chemicals. Another doctor later found that the tissue protecting her corner was exfoliating.
